A complicated issue
Child support can be complicated, confusing and a sensitive issue. It is very important, however, that the calculation is correct and the amount not too high or too little.
Attorney Kimberly Schultz has over 10 years of experience in this and will help you through thoughtful advocacy to get the financial support that your child is entitled to.
What amount of child support can I get?
Under Florida law, both parents should provide for their children and it is the child’s right that his/her basic needs be met. The amount of child support that a parent can receive is based on guidelines provided within Florida Statutes. These guidelines judge a lot of factors in calculating child support.
The number of children and the combined income of the parents is considered. The cost of daycare and health insurance are incorporated, as well as the number of nights each parent spends with the child. All of this can influence the outcome of the child support calculation.
Modification of child support
Circumstances change. We all know that. A parent can seek modification of a prior child support award if he/she can show that a substantial change in circumstances has occurred. It can be the loss of a job, a permanent decrease in income, or a disability.
A request for modification has to be filed as soon as possible, as it is only effective from the date of filing onward. Child support owed prior to the filing will not be affected.
You should contact an experienced Florida family law attorney immediately if your circumstances change and you need modification of child support.
